Bankruptcy Court Approves Settlement Agreement for Energy Company

Order –

The Hon. Christopher S. Sontchi approved a settlement between NextEra Energy, Inc., the EFH Plan Administrator Board, UMB Bank, N.A., Elliott Associates, L.P., Elliott International, L.P., and the Liverpool Limited Partnership in the District of Delaware matter captioned In re Energy Future Holdings Corp., et al., Case No. 14-10979. The settlement comes after Fleischman Bonner & Rocco secured a reversal from the Third Circuit, which remanded the matter to the District Court and Bankruptcy Court for further proceedings concerning NextEra’s administrative expense application. The terms of the settlement provide that NextEra be “granted an Allowed Administrative Claim under the Plan in the amount of $15 million,” and require payment of $4 million from the EFH Plan Administrator Board to NextEra.
